These Terms of Service ("Terms") govern your use of the WCAG Repair website at wcagrepair.com (the "Service") operated by WCAG Repair ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

WCAG Repair is an AI-powered WCAG 2.1 accessibility audit platform. The Service allows you to:

  • Scan a URL for free to receive a summary of accessibility issues found.
  • Purchase a full AI-generated remediation guide PDF for $29 per scan.
  • Optionally subscribe to ongoing accessibility monitoring for $7 per month.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Submit URLs that you do not have authorization to scan.
  • Attempt to circumvent rate limits or abuse the scanning infrastructure.
  • Use automated tools, bots, or scripts to access the Service in a manner that exceeds reasonable use.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to harass, harm, or interfere with any third party or their websites.
  • Resell, redistribute, or sublicense remediation guides or scan results without our written permission.

We reserve the right to suspend or terminate your access to the Service at any time if we reasonably believe you are violating these Terms.

3. Accounts and Access

The Service does not require account creation. Scans are identified by unique URLs, and purchases are associated with the email address provided during checkout. You are responsible for maintaining the confidentiality of your download links and scan result URLs.

4. Payments and Pricing

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's Terms of Service.

  • Remediation Guide: A one-time payment of $29 per scan. The guide is delivered as a downloadable PDF.
  • Monitoring Subscription: $7 per month, billed monthly through Stripe. The subscription includes automated recurring scans and fix reports.

Prices are listed in US dollars and are subject to change. Any price changes will not affect existing active subscriptions until their next renewal period.

5. Refund Policy

Because remediation guides are digital products generated on demand, we generally do not offer refunds once a guide has been delivered. However, if you experience a technical issue that prevents delivery of your guide, or if the guide is substantially incomplete or defective, please contact us at support@wcagrepair.com within 14 days of purchase and we will work with you to resolve the issue, which may include issuing a refund at our discretion.

For monitoring subscriptions, you may cancel at any time. Cancellation takes effect at the end of the current billing period, and no partial refunds are provided for unused time.

6. Intellectual Property

All content, design, code, and branding of the Service are owned by WCAG Repair and are protected by applicable intellectual property laws. Upon purchase, you receive a non-exclusive, non-transferable license to use the remediation guide for your own internal purposes (such as fixing accessibility issues on the scanned website).

You may not reproduce, distribute, or publicly display the guide content except as needed to implement the recommended fixes on your own website or for your clients.

7. NOT LEGAL ADVICE — IMPORTANT DISCLAIMER

WCAG REPAIR IS A TECHNOLOGY SERVICE, NOT A LAW FIRM, AND DOES NOT PROVIDE LEGAL ADVICE.

Our Service provides technological assistance only. Scan results, remediation guides, and all other outputs are technical recommendations intended to help you identify and address potential accessibility issues on your website. They are not legal opinions, legal counsel, or guarantees of legal compliance of any kind.

You acknowledge and agree that:

  • No output from the Service constitutes legal advice, a legal opinion, or a guarantee of compliance with the Americans with Disabilities Act (ADA), Section 508, the European Accessibility Act, or any other applicable law, regulation, or standard.
  • Web accessibility standards — including WCAG — are updated, revised, and reinterpreted on a regular basis by standards bodies, regulatory agencies, and courts. What constitutes compliance today may not constitute compliance tomorrow.
  • Automated scanning tools (including the axe-core engine used by our Service) can only detect approximately 30–50% of all potential accessibility issues. Many accessibility requirements can only be evaluated through manual testing with assistive technologies and by users with disabilities.
  • AI-generated remediation recommendations are produced by machine learning models and may contain errors, omissions, inaccuracies, or recommendations that do not apply to your specific context.
  • Achieving and maintaining full WCAG compliance requires ongoing human judgment, manual testing, user research, and professional expertise beyond what any automated tool can provide.
  • You should consult with a qualified accessibility consultant and/or legal professional for definitive guidance on your compliance obligations.

We take every measure to stay at the forefront of evolving accessibility standards and best practices, but we make no guarantees that our Service reflects the most current version of any standard at any given time.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR SUITABILITY FOR ANY PARTICULAR COMPLIANCE REQUIREMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • Scan results will identify every accessibility issue on your website.
  • Implementing the remediation guide will result in full or partial WCAG 2.1 compliance or protect you from legal claims, lawsuits, demand letters, regulatory action, or any other legal proceeding.
  • The AI-generated recommendations will be free from errors, omissions, or inaccuracies.
  • Our Service reflects the most current version of WCAG or any other accessibility standard at the time of your scan.
  • Any results, reports, or recommendations will be accepted by any court, regulatory body, plaintiff, or third party as evidence of compliance.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WCAG REPAIR, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY OF THE FOLLOWING ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE:

  • Any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind.
  • Any loss of profits, revenue, business, data, goodwill, or anticipated savings.
  • Any damages arising from your reliance on scan results, remediation guides, or any other output of the Service.
  • Any damages arising from accessibility-related lawsuits, demand letters, settlements, judgments, regulatory fines, or other legal proceedings brought against you by any party.
  • Any damages arising from your failure to achieve or maintain compliance with WCAG, the ADA, Section 508, or any other accessibility law, regulation, or standard.
  • Any damages arising from errors, omissions, or inaccuracies in AI-generated recommendations.
  • Any damages caused by changes to accessibility standards, laws, or regulations after the date of your scan or report.

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WCAG REPAIR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE LESSER OF: (A) THE AMOUNT YOU ACTUALLY PAID TO WCAG REPAIR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS ($50.00).

BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE THAT YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF SCAN RESULTS AND REMEDIATION RECOMMENDATIONS, AND YOU AGREE THAT WCAG REPAIR SHALL NOT BE HELD RESPONSIBLE FOR ANY CONSEQUENCES ARISING FROM YOUR RELIANCE ON THE SERVICE'S OUTPUTS.

10. Indemnification

You agree to indemnify and hold harmless WCAG Repair and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Third-Party Websites

The Service scans third-party websites at your direction. We are not responsible for the content, privacy practices, or terms of any third-party websites you submit for scanning. You represent that you have the right or authorization to scan any URL you submit.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
